Terms & Condition
The Terms and Conditions below are legally binding on you as a user of this IPAYMORE4GOLD.com Website and/or as a customer of YGIC, INC. (hereinafter referred to as "YGIC") and inure to the benefit of YGIC and its successors and assigns.
Guaranty Against Loss / Limitations of Liability
If there is a loss of the contents of a package that you properly shipped to YGIC in accordance with the instructions and procedures set forth on the IPAYMORE4GOLD.com Website, YGIC will guaranty you against such loss, subject to these Terms and Conditions.
YGIC's liability under such loss guaranty or otherwise will be limited to one-third (1/3) of the value of the lost contents or One Hundred ($100.00) Dollars, whichever is less.
If you believe your gold, jewelry or other property (hereinafter referred to as "Merchandise") is worth more than $100.00, we recommend that you insure your shipment for more at your own expense using USPS.
If you do not provide YGIC with an original sales slip or appraisal (issued prior to the shipment to YGIC) for the lost contents, the value of your contents will be liquidation value and YGIC's liability, therefore, will be limited to Thirty-Three and 00/100 Dollars ($33.00). If you provide an original sales slip or such appraisal, the value of your contents will be based on such sales slip or appraisal. YGIC's liability, however, will be limited to One Hundred and 00/100 Dollars ($100.00).
You expressly acknowledge and agree that if you do not provide a sales slip or appraisal that was issued prior to the contents being submitted to YGIC, YGIC's determination of value shall be conclusive and binding.
Without limiting the foregoing, this guaranty will apply only to Merchandise shipped in YGIC packaging supplied by YGIC. YGIC reserves the right, in its sole discretion, to reject delivery of any mail, envelope or package that appears damaged, opened or tampered with, and any such rejected mail, envelope or package will be returned to you via U.S. Mail. YGIC will have no liability to you for any such attempted delivery or return of any such items.
Except as expressly provided in these Terms and Conditions, YGIC will have no liability to you whatsoever, whether arising in connection with your use of the IPAYMORE4GOLD.com Website, YGIC's loss of gold, jewelry or other property or for any other reason, including, without limitation, YGIC's own acts or omissions. In no event will YGIC's liability to you exceed One-Hundred and 00/100 Dollars ($100.00). YGIC will not be liable to you for any damages, including but not limited to, incidental, consequential, punitive, loss of profit or opportunity, other than as expressly set forth in these terms and conditions.
Binding Effect
These Terms and Conditions, including, without limitation, the limitations of liability, will be binding on you and all third parties, including, but not limited to, your successors, assigns, insurance carriers and any other individual or entity asserting any right or claim relating to your transaction with YGIC. In no event will YGIC be liable to any third party, including any insurance carrier. YGIC will not be liable for any subrogation claim brought by your insurance carrier, and, by submitting any property to YGIC, you expressly and specifically waive any such subrogation claim on your behalf as well as on the behalf of your insurance carrier.
Oral Offers
You may request YGIC to provide a telephone or e-mail quote for your items after such items have arrived at YGIC's processing facility. Such offers may, at the discretion of YGIC, be recorded. Upon your acceptance, oral or written, of such quote, you will be legally bound by such transaction, payment will be issued by YGIC within twenty four (24) hours and you will not have the opportunity to return your check and receive your items back from YGIC.
Ownership of Merchandise
You agree that:
You are at least 21 years old.
You are the legal owner of your Merchandise that you wish to sell to YGIC;
You are acting on your own behalf, and not as another’s agent or representative; and
Your Merchandise is free of any and all claims, liens, or anything else that might adversely effect the value of your Merchandise or your ability to sell it to YGIC.
Valuing your Merchandise
YGIC will assess the value of your Merchandise using a calculation based primarily on the afternoon London Gold Fixing on the day YGIC processes your Merchandise, a formula based on the karat and weight of the Merchandise, and any other factor that YGIC deems to be appropriate.
Settlement
Upon processing your Merchandise, YGIC will notify you by email or telephone of our settlement payment for your Merchandise (“Settlement”). You must accept or decline your Settlement within twenty-four (24) hours after YGIC notifies you of the Settlement. If, however, you have not requested notification via telephone and/or email and are unhappy with your settlement check you have the option of sending the check back unsigned within ten (10) days of the issue date on check. If the settlement check is sent back within ten (10) days from the issue date, YGIC will ship your Merchandise back to you insured at no cost to you.
Any verbal agreement or payment via PayPal™ will result in the loss of the ten (10) days return policy.
Method of Payment
You can select one of the following methods of payments for your Settlement:
Company check sent via USPS;
Company check sent via DHL Overnight, Or 2nd Day shipping with the fee deducted from the payment of your Settlement;
Direct deposit into your PayPal™ account in accordance with the instructions you provided to YGIC; or;
If you fail to select a method of payment, then you will receive a company check via USPS.
It is your responsibility to know the Terms and Conditions of the method of payment you select as set forth herein and as stated on our website.
By selecting the payment of your Settlement by direct deposit into your PayPal™ account, you acknowledge and agree that if you affirmatively accept the Settlement within the time frame set forth herein, or accept the Settlement by default (i.e., by failing to decline or accept the Settlement within the time frame set forth above) the Transaction is final, payment will be sent to you by the method you selected. YGIC will own the Merchandise, and you will have no right to decline the Settlement or request that the Merchandise be returned. You further acknowledge and agree that if you had selected payment by company check instead of by direct deposit, you would have had a right to a return period as specified below.
Settlement Paid by Company Check
If you selected payment by company check from YGIC, and you do not agree with the Settlement or change your mind after accepting the Settlement, then within 10 business days from the date of the check: (a) you must notify YGIC via email at info@ipaymore4gold.com - or telephone at 954-558-4670 - that you now choose to decline the Settlement and will be returning the un-cashed Unsigned check to YGIC on a timely basis, and (b) YGIC must receive your returned un-cashed Unsingned check within ten (10) business days from the date of the check. You are responsible for sending us the un-cashed check at your expense, and the check must be sent to us at the address indicated in the upper left hand corner of the check. If you satisfy the requirements set forth in this paragraph, then YGIC will return your Merchandise as specified herein. Failure to satisfy the requirements set forth in this paragraph will cause you to forfeit your right to decline the Settlement, the Transaction will be final, YGIC will own the Merchandise.
If you selected payment by company check and you notify YGIC by email or telephone that you decline the Settlement before payment is processed and before a company check is sent to you, then YGIC will return your Merchandise to you as specified herein.
Returned Merchandise– Outbound Insurance, Costs, Insurance
In the event that your Merchandise is returned to you in accordance with these Terms and Conditions, YGIC will ship your Merchandise to you at your address as it appears in our records via DHL or USPS at its expense, and will insure the Merchandise for the full value of the rejected Settlement. If a package containing your Merchandise is lost in transit while being returned to you in accordance with these Terms and Conditions, YGIC will file a claim with DHL or USPS and pay you the full value of the rejected settlement.
Electronic Signature
For purposes of the transaction, you hereby agree to the use of Electronic Signatures, receipt of notices by e-mail, use of Electronic Contracts, and to accept these Terms and Conditions by electronic means. You agree that by clicking the acceptance box at the end of Request Free Mailer, or Request Information About Shipping Your Own Package, constitutes your Electronic Signature.
Miscellaneous
You agree that you provided to YGIC the email address, physical address, and telephone numbers that are in our records, and it is your responsibility to provide YGIC with any current or updated contact information. You further agree that: (a) any email message that YGIC sends to you is deemed to have been effectively received by you and constitutes due notice to you by email; and (b) any phone message YGIC leaves with you, anyone answering your phone, or on your answering machine or service is effectively received by you and constitutes due notice to you by telephone.
YGIC INC. is licensed to do business in the State of Florida and is governed by the laws of the State of Florida. This Agreement shall be governed by, interpreted under, and construed and enforced in accordance with the laws of the State of Florida, applicable to agreements made and to be performed wholly within the State of Florida, without regard to other principals and choice of laws. In the event a judicial proceeding is necessary, the sole and exclusive forums for resolving disputes arising under or related to this Contract are Circuit Courts of the State of Florida in and for Broward County, or the Federal District Court for the Southern District of Florida, and all related appellate courts. The parties hereby consent to the jurisdiction of such courts, and agree that venue shall be in the aforesaid state, county and district.
All references to days shall refer to business days. Sundays, and federal legal holidays are not included as business days, and if the expiration of any time frame set forth above falls on a, Sunday, or federal legal holiday, performance will be due on the next business day. Merchandise received after 2:00 p.m., or on any Sunday, or federal legal holiday will be considered to have been received on the next business day. All business days will begin at 10.00 a.m. and end at 6:00 p.m. in Florida on the appropriate day.
Notwithstanding any other provision herein to the contrary, YGIC reserves the right to suspend or enlarge any time frame specified above, and/or request additional documents or information from you, in order to comply with any applicable local, state, or federal law, ordinance, or regulation. Furthermore, any time frame set forth above may be suspended or extended in our discretion with or without notice to you in the event that YGIC encounters technical difficulties concerning its Website or otherwise including but not limited to fires, hurricanes, and other storms.
